In recent months it has been heard in the media that “On January 1, paper 0”, this proposal strongly promoted by the Minister of Justice Rafael Catalá, is the summary of the digitization plan of the Administration of Justice, the latest progress of which is has occurred at the end of November with the publication of the decree for the definitive implementation of LexNet, an electronic communication system that will be mandatory for lawyers and attorneys as of January 1, 2016. This plan aims to end the collapse in the courts and the photos that circulate of the court offices with mountains of files piled chaotically everywhere.
The obligation to use LexNet for communications with the courts should begin to be required by law as of January 1, 2016, although the reality is very different, there are several autonomous communities that have already expressed their inability to comply with it. . Among the reasons, the lack of means, lack of information and the plurality of procedural management systems used by the different autonomous communities and which are incompatible with each other stand out.
The LexNet program is not new, it has been used for a few years in some provincial capitals but only for notifications to attorneys, now it is intended to be used for any communication between lawyers and the courts, which has caused great concern in this collective. Seminars and courses have multiplied to try to master this system.
Another controversy that has been created is due to the fact that when demands have to be made through LexNet, all the documents accessory to the demand (Photos, reports...) must be attached through this system, but LexNet has a limitation on size and You can only send 10 megabytes and certain file formats, which are pdf, rtf, jpg and tif. The decree provides that written documents have a specific PDF format, which is OCR (optical character recognition, so that a text editing program can be applied to them). And many people neither know it nor know what programs are necessary. Because you export a text written in Word or LibreOffice to PDF and it has OCR, but a scanned page does not.
Another unknown with the new system is whether it will have the capacity to function correctly when everyone is using it.
