What is the floor clause?

This is a clause within the mortgage loan deed that establishes the minimum interest to be paid in the monthly installments of the mortgage contracted even if the ordinary interest agreed upon (Euribor) with the financial institution is below.

Can I recover the money I paid to the developer for the construction of my home, if it was never built?

Yes, of course you can. Many homebuyers are unaware that even if the property is never built, and the developer or construction company has gone out of business, there is a possibility of recovering your money. The amounts you deposited into the developer's or construction company's bank account for the purchase of the property are guaranteed under Law 57/1968 , and you can get them back. I am a cooperative member of a house that was never built and for which I paid amounts on account. However, I do not have collateral that guarantees the recovery of my money. Can I now recover the amounts I once contributed?

Yes, even if there is no guarantee, these amounts are guaranteed by Law 57/1968, and you will be able to recover them. We are a firm specializing in this matter with hundreds of cooperative members among our clients who have already recovered their money.

How can I know if my mortgage contains the floor clause?

The application of the clause appears in the deed of the mortgage loan and usually appears under headings with titles such as “limits to the application of variable interest”, “limit of variability” or “variable interest rate”. There are five or six lines in which it is established that the interest can never be lower, in the case of the floor, or higher, in the case of the ceiling, than a certain percentage.

Do I have the obligation to contract payment protection life insurance with the Bank with whom I am going to take out my mortgage?

If you are going to take out a mortgage loan with a Bank, it cannot force you to take out any type of insurance or policy, be it life insurance, pension plan, home insurance...

Surely, in the previous negotiations, the Bank staff told you that this connection is mandatory, however there is no Law that requires it, and therefore you can refuse.

If in the end you accept, otherwise they may not grant you the loan, what you can do is that when the time comes to renew it, not agree to said renewal, since you will not find any clause in your deed that requires you to renew it.

I cannot afford four installments of my mortgage loan and the Bank has decided to mature the loan early, is this legal?

Until now, it was enough for the debtor to stop paying a portion of his loan so that the entity could terminate it early and begin the execution procedure. However, after the ruling of the ECJ, the possibility of declaring this type of clauses abusive has been left open, since the early maturity must be in accordance with the duration of the loan, otherwise we can initiate a judicial procedure to declare the nullity of the clause. early expiration due to abuse.
