Below are some of the most frequently asked questions received by our team of family lawyers in Murcia.

The house where we have lived during the marriage has a fairly significant mortgage, I am going to stay with the minors in the house, therefore, my husband tells me that I have to face the mortgage alone, and I currently do not have a job, this is so?

The payment of the mortgage corresponds to the owners of the home, in this case, to both spouses (assuming that their marriage is regulated by the community property regime) so both parties must pay in half, without prejudice to whether one of them pay in full and subsequently be compensated for it in the liquidation of assets.

I have been married for eight years and we have a minor child, five years old, the house where we live belongs only to my husband who bought it before our marriage, in case I was granted custody of my son, Will I be able to stay in the home or will I still have to leave because I am deprived of it?

Although the house is the private property of your husband, the judge will assign its use and enjoyment to the parent who has custody of the child until the child achieves economic independence. Therefore, if you are the custodial parent, you will continue to live in the house with your child until the child becomes financially independent.

My husband has stopped paying child support to my children, claiming that he does not have a job and therefore cannot pay it. Can I do something to continue paying child support to my children and what are the consequences of these non-payments?

This situation of non-payment of child support can be viewed in two ways: as a criminal offense punishable under our Penal Code, and as a breach of a civil judgment, thus initiating civil enforcement proceedings. In either case, the payment of outstanding child support will be ordered, provided that payments have indeed ceased, even if economic reasons are alleged. Such reasons must be assessed by the family court judge through a modification of the judgment, not through this civil procedure.

I have been married for 20 years, and since then I have not worked outside the home, we have two minor children, and we want to get divorced. Can I request, in addition to the child support, another for myself?

To grant a compensatory pension in your favor, that is, a pension intended for that spouse who is in a situation of imbalance after the breakdown of the marriage, the judge will assess many factors including: your age, the age at which you contracted marriage, whether or not you worked before marriage, whether you have academic training... therefore each case must be analyzed specifically to be able to advise you correctly.
