I am divorced and I want to make a will leaving all my assets to my minor children, but after my death I do not want my ex-partner, their mother, to be in charge of managing my assets until they reach majority, can I do something?

Yes, in your will you can dispose according to your will and in accordance with the Law, therefore, it is perfectly possible to exclude your ex-partner from the administration and rights that your children will inherit and appoint a person you trust, this is what known as executor, to be in charge of said management.

My mother lived in Italy for many years and her children live in Spain. She has left us a house in Rome and we have paid the corresponding taxes there, do we have to pay anything here in Spain?

You must pay the inheritance tax to the Spanish State Tax Agency, taking into account that you may deduct from the resulting amount the amount you have paid in Italy for this concept.

My husband has died without leaving a will and we do not have children either, his parents are currently living, who will inherit his assets, his parents or me as his widow?

The applicable law must be taken into account because if it is a provincial territory, Catalonia, the Balearic Islands, the Empty Country and Valencia, its corresponding Law will be applied in accordance with its regulations.

But in common law, in the rest of the national territory the Civil Code will apply and according to it the parents and ascendants will be called in the intestate succession before the widowed spouse.

We are three brothers after the death of my mother, and one of them does not want anything from the inheritance, he intends to renounce it, what happens to his part, does it influence us over our part?

It will depend on whether or not the deceased left a will . If she did, the provisions contained therein will be followed, as well as whether her mother foresaw this possibility and named a substitute heir in case she renounced the inheritance. If there is no will, the proportional share will increase; this is known as the right of accrual.
