Verification of Values by the Treasury

Verification of Values by the Treasury

When someone buys a property, or acquires it by inheritance or donation, and pays the taxes, they cannot rest assured because if the taxes paid do not correspond to the values that the Treasury assigns to the property, it is very likely that within a period of 4 years they will receive a letter notifying you that the Treasury is issuing you a complementary settlement to the one initially presented for verification of values of the assets or rights acquired.

Do not believe that what the Treasury says is correct, since many resources are earned due to errors by the Treasury when carrying out the valuation of the real estate.

What is value checking?

It is the complementary liquidation, when the Treasury considers that the value is greater than that declared in the acquisition of assets or inheritance, etc...

What can the taxpayer do when faced with a verification of values?

When we receive the letter from the Treasury notifying us of the complementary tax settlement, it is very important to contact a lawyer specializing in these procedures since we have a period of time to choose several ways that can avoid said payment.

There are several options:

  • Pay the claimed amount: the difference between the amount initially paid and the amount estimated by the treasury based on the values determined by it, plus the default interest accrued for payment outside the established period, accepting without conditions the review of values carried out by the administration
  • Challenge the complementary liquidation: file an appeal for reconsideration that will be resolved by the same liquidation office that dictates the act, or directly a claim before the regional economic-administrative court; Both must be filed within a period of one month, so it is very important not to let the days pass and contact a lawyer as soon as possible.
  • Contradictory expert appraisal: Request that the administration appoint an expert appraiser to value the property, and depending on the result of said appraisal, the amount claimed will be paid or not.

If you have any questions or queries, or if you have received a complementary settlement for verification of values, do not hesitate to contact us. We can help you.
