Problems at work due to having a criminal record?

Having a criminal record can be a problem in certain professions, since the company may require a clean record. There are some legislative changes that indicate which professions are governed by this criterion.

Especially now that we are in the summer season, children's entertainment companies or all those that work with minors have to present a document proving that they have not been convicted of crimes against sexual integrity.

There are many other professions that also require that you not have a record of intentional crimes, or have them cancelled.

As criminal records belong to a private sphere, it may attract attention that companies request them, but it is a common practice that occurs in many sectors, including public administration, such as teachers, police officers and any administrative body.

The criminal record certificate could only be requested by the interested party and the judicial bodies, although there are certain cases in which the administration makes an automatic request, even in certain professions the public bodies have direct access, such as in the case of police officers, security guards, etc. The interested party could also sign an authorization for another person to request it.

Although the record does not remain for life, the criminal record can be canceled when the person has satisfied the criminal and civil responsibilities derived from the crime and has gone a period of time without being convicted again.

Cancellation can be requested from the Ministry of Justice once the requested requirements are met; once requested, there is a period of three months to be deleted.

The deadlines would be the following:

  1. Minor crimes (6 months)
  2. Less serious crimes (3 months)
  3. Crime with sentences (5 years)
  4. Omission of crime (10 years)
  5. Crime for sexual abuse (30 years)
