Have you requested a disability and been denied?

 In most cases, when a disability is requested, the INSS usually resolves negatively, giving us a period of 1 month to be able to appeal to said resolution. To do so, we must contact a specialist lawyer to inform us which is the best way and which documents are necessary for this type of procedure.

The most important thing in these cases is to be able to prove with reports from a specialist that the person is incapable of performing fundamental tasks of their profession or trade. The reports should preferably be from public health since the judges give them more credibility, by not be hired by the party.

The illness must be related to the acting profession so that the same injury may or may not constitute IPT depending on the disabling consequences on the applicant's profession.

Once we obtain the denial, which is most likely since there is not much money in the Social Security Treasury, we will have to make a prior claim to go to court, the trial will be against Social Security, in case of denial on this part we would have to go to the Superior Court of Justice.

Necessary documentation:

-INSS disability application

-Medical reports

-Low and high parts (if applicable)

-INSS resolution
